بخوش دليلة2025-06-102025-06-10https://dspace.univ-bba.dz/handle/123456789/321مذكرة لنيل شهادة الماستر تخصص تهيئة و تعمير جامعة محمد البشير الإبراهيميتهدف هذه الدراسة و الموسومة بعنوان آليات الرقابة القبلية على أعمال البناء في قانون التهيئة والتعمير إلى الوقوف على مختلف الإجراءات المتبعة خلال عملية استصدار الرخص والشهادات بالإضافة للمخططات ، فضلا عن الحديث عن مختلف المنازعات المتعلقة بشهادة التعمير ورخصة التجزئة و رخصة البناء، وقد تم الاعتماد في هذه الدراسة على المنهج الوصفي،بالاستناد على أسلوب التحليل. وقد توصلت الدراسة إلى عدة نتائج أهمها توضيح وتبين الإجراءات الواجب إتباعها عند طلب استصدار الرخص والشهادات المتعلقة بالبناء والتعمير المتمثلة في الملفات التي يجب تحصيلها والوثائق المطلوبة،بالإضافة إلى أن رخص وشهادات التعمير تعتبر ضمانات أساسية لفرض التطبيق السليم لما هو وراء مخططات التهيئة والتعمير كما أنها ميكانيزمات للرقابة القبلية على النشاط العمراني، يستوجب منها من طرف الهيئات المختصة. الكلمات المفتاحية: الرقابة القبلية،أدوات التعمير،قانون التهيئة والتعمير،المخطط التوجيهي للتهيئة والتعمير،مخطط شغل الأراضي، شهادة التعمير،رخصة التجزئة،رخصة البناء،المنازعات. Summary: This study, titled Mechanisms for Tribal Control of Construction Works in the Planning and Development Law, aims to identify the various procedures followed during the process of issuing licenses and certificates in addition to plans, as well as to talk about the various disputes related to the construction certificate, the retail license, and the building permit. This study was based on Descriptive approach, based on the analysis method. The study reached several results, the most important of which is clarifying and clarifying the procedures that must be followed when requesting the issuance of licenses and certificates related to building and reconstruction, represented by the files that must be collected and the required documents, in addition to Construction permits and certificates are considered basic guarantees for enforcing the proper implementation of what is behind development and reconstruction plans. They are also mechanisms for tribal control over urban activity, which are required by the competent bodies.
