داود صبرينةبن روضة أم هاني2026-03-032026-03-03https://dspace.univ-bba.dz/handle/123456789/1256مذكرة لنيل شهادة الماستر تخصص قانون أعمال جامعة محمد البشير الإبراهيميحدد المشرع الجزائري وفقا لأحكام القانون رقم 22/18 المتعلق بالاستثمار، مجالات ونشاطات الاستثمار التي يمكن لها الاستفادة من المزايا، بهدف توفير مناخ محفز للاستثمار المحلي والاجنبي والتشجيع على التنافس النزيه. الامر الذي استلزم منح تحفيزات ومزايا للمستثمرين، قسمت إلى ثلاثة أنظمة تحفيزية مستحدثة، النظام التحفيزي للقطاعات ذات الأولوية، والنظام التحفيزي للمناطق التي توليها الدولة أهمية خاصة، إضافة إلى النظام التحفيزي للاستثمارات ذات الطابع المهيكل. وقد ربط المشرع استفادة المستثمر من هذه التحفيزات بضرورة توفر شروط واتباع إجراءات معينة تتجسد أساسا في تسجيل الاستثمار على مستوى الوكالة الجزائرية لترقية الاستثمار التي تلعب دور المرافق للاستثمارات، تحت اشراف المجلس الوطني للاستثمار، الذي يعد كمركز اتخاذ قرار اقتراح استراتيجية الدولة في مجال الاستثمار، والسهر على تناسقها الشامل وتقييم تنفيذها. الكلمات المفتاحية: الاستثمار، الأنظمة التحفيزية، المزايا. Abstract : In accordance with the provisions of Law No. 22/18 on Investment, the Algerian legislator has identified investment areas and activities that can benefit from these incentives, with the aim of providing a conducive climate for local and foreign investment and encouraging fair competition. This necessitated the granting of incentives and benefits to investors, divided into three newly created incentive systems: the incentive system for priority sectors, the incentive system for regions that the state attaches particular importance to, and the incentive system for structured investments. The legislator has linked the investor's benefit from these incentives to the availability of certain conditions and the implementation of certain procedures. These include registering the investment with the Algerian Investment Promotion Agency, which plays the role of an investment facilitator, under the supervision of the National Investment Council, which serves as the decision-making center for proposing the state's investment strategy, ensuring its comprehensive consistency, and evaluating its implementation.
