أسماء لرقطأشواق زغبي2026-04-302026-04-30/https://dspace.univ-bba.dz/handle/123456789/1416مذكرة لنيل شهادة الماستر تخصص قانون أعمالالملخص : تتناولت دراستنا موضوع المحررات الإلكترونية ومدى حجيتها في الإثبات وذلك نتيجة للتطور الذي شهده العالم في السنوات الأخيرة. وقد ركزنا على الإطار القانوني الذي ينظم المحررات الإلكترونية، مستندًا في ذلك إلى مبدأ التوازن الوظيفي، كما ورد في المادة 323 مكرر 1 من القانون المعدل رقم 05-10. كما تطرقت دراستنا إلى الحجية القانونية للمحرات الإلكترونية، حيث منح المشرع الجزائري لها نفس القوة الإثباتية التي تتمتع بها المحررات الورقية فالقانون 15-04 المتعلق بالتوقيع والتصديق الإلكتروني، يُضفي الحجية على المحررات الإلكترونية من خلال التوقيع الإلكتروني ويمنحها قوة إثباتية مساوية للوثائق التقليدية وقد خلصت دراستنا إلى أن الاعتراف القانوني بالمحررات الإلكترونية أصبح أمرًا ضروريًا في ظل المعاملات الإلكترونية الحديثة، وهو ما يتطلب تعزيز ثقة المتعاملين في التجارة الإلكترونية وتطوير البنية التشريعية لتوفير ضمانات كافية لحماية هذه المحررات ومنع التلاعب بها. Abstract Our studyaddressed the topic of electronic documents and the extent of theirvalidityevidence. This comes as a result of the technologicaldevelopmentwitnessed by the world in recentyears. Wefocused on the legalframeworkthatgovernselectronic documents, based on the principle of functionalequivalence, as stated in Article 323 bis 1 of the amended Law No. 05-10. Our studyalsocovered the legal protection of electronic documents, as the Algerian legislatorgrantedthem the sameevidentiary value as paper documents. Law No. 15-04, related to electronic signature and authentication, addslegal protection to electronic documents throughelectronic signature, grantingthemevidentiary power equal to traditional document Our studyconcludedthatlegal recognition of electronic documents has become essential in light of modern digital transactions. This necessitatesstrengthening the confidence of parties involved in electronic commerce and developing the legislativeframework to provideadequatesafeguards to protectthese documents and preventtheir manipulation.Other
