دقداقي يوسفبزي بدر الدين2026-02-232026-02-23https://dspace.univ-bba.dz/handle/123456789/1239مذكرة لنيل شهادة الماستر تخصص قانون أعمال جامعة محمد البشير الإبراهيميتهدف هذه المذكرة إلى دراسة نظام الإثبات بالكتابة في القانون المدني الجزائري، باعتباره أحد أهم وسائل الإثبات القانونية التي اعتمدها المشرّع الجزائري لضمان استقرار المعاملات المدنية. وقد تناولت الدراسة الأحكام العامة التي تحكم هذه الوسيلة، والقيود التي فرضها القانون بشأن إلزامية الكتابة، وكذا الاستثناءات التي تجيز الإثبات بغيرها في حالات معينة. كما تم التطرق إلى أنواع المحرراتالمعتمدة في الإثبات، سواء الرسمية أو العرفية أو الإلكترونية، مع تحليل لطبيعتها القانونية وقوتها الثبوتية، وإجراءات الطعن فيها. توصلت الدراسة إلى أن الكتابة تُعد وسيلة إثبات رئيسية، تتفوق من حيث القيمة القانونية على غيرها من الأدلة، وتفرض في حالات محددة لضمان حماية الحقوق. كما كشفت عن أهمية تطوير الإطار القانوني المرتبط بالإثبات الإلكتروني بما يتماشى مع تطورات البيئة الرقمية الحديثة. الكلمات المفتاحية:الإثبات بالكتابة – القانون المدني الجزائري – المحررات الرسمية – المحررات العرفية. Study summary This memorandum aims to examine the system of written evidence in Algerian civil law, as it is one of the most important legal means of evidence adopted by the Algerian legislator to ensure the stability of civil transactions. The study addresses the general provisions governing this means, the restrictions imposed by law regarding the mandatory nature of writing, and the exceptions that permit proof by other means in certain cases. It also addresses the types of documents used in evidence, whether official, informal, or electronic, with an analysis of their legal nature, probative force, and the procedures for challenging them. The study concludes that writing is a primary means of evidence, superior in legal value to other forms of evidence, and is imposed in specific cases to ensure the protection of rights. It also reveals the importance of developing the legal framework related to electronic evidence in line with developments in the modern digital environment.
