Abstract

حاولنا من خلال بحثنا هذا التعرف على الوكيل العتمد لدى الجمارك في القانون الجزائري تجدر الإشارة أنه خلال فترة التحول إلى نظام إقتـصاد الـسوق فإنـه يكـون مستحيلا عمليا على أغلبية المستوردين و المصدرين أن يكونوا على علـم دائـم بمختلف الأحكام التي تنطبق على عملياتهم ، لهذا فإنهم يجيدون أنفـسهم ملـزمين باللجوء إلى الوكيل المعتمد لدى الجمارك و هذا بالنظر إلى خبرته و كفاءته فـي مجال جمركة البضائع ، و الذي يعتبر شريك و مساعد لإدارة الجمارك بإعتبـاره يتدخل في إنجاز العديد من عمليات جمركة البضائع من أجل إلقاء الضوء على مهنة الوكيل المعتمد لدى الجمـارك المتمثلـة فـي جمركة البضائع لصالح الغير حاولنا من خـلال هـذا البحـث تحديـد مفهومـه وإلتزاماته و المسؤولية الصارمة الملقاة على عاتقه ، كما أن الوكيل للقيام بمهنتـه لابد له من الحصول أولا علـى إعتمـاد مـن إدارة الجمـارك وفـق الـشروط والإجراءات المحـددة فـي المرسـوم التنفيـذي رقـم 99/197 المـؤرخ فـي 16/08/1999 و المتضمن شروط ممارسة مهنة الوكيل المعتمد لدى الجمارك و كيفياتها .

و تجدر الإشارة أن سلطة منح وسحب إعتماد الوكيل المعتمد لدى الجمارك مخولة في الجزائر إلى المدير العام للجمارك و هذا خلافا لما كان عليه قبل تعديل قانون الجمارك و الذي كان يخولها للوزير المكلف بالمالية و هـذا مـا يعـد تـسهيل للأشخاص الراغبين في ممارسة مهنة الوكيل المعتمد لدى الجمارك .

و من خلال إستعراضنا لإجراءات الجمركة التي يجب على الوكيل المعتمد لـدى الجمارك القيام بها لاحظنا أنها عملية جد معقدة و تتطلب وقت طويل و لذلك يجب عليه أن يكون على علم تام بهذه الإجراءات و كذا مختلف الوثائق و الإسـتمارات المستعملة .

و مـن جهة أخرى فأن الوكيل المعتمد لدى الجمارك لا يتلقى أية تعليمـات مـن طرف زبونه بالنسبة للطريقة التي يتبعها للقيام بعمله ذلك أن الوكيل المعتمد لـدى الجمارك يعتبر مهني متخصص و هو على علم بكل الشروط و الإجراءات التـي يجب أن يتبعها و ما على زبونه إلا تزويده بكل الوثائق و المعلومـات المتعلقـة بالبضاعة وهو وحده من يتكفل بالعمل بعد قيامه بعملية التحريات اللازمة .

و لذلك نرى من الضروري أن تعمم إدارة الجمارك إستعمال الإعلام الألي حتـى يسهل على الوكيل المعتمد لدى الجمارك القيام بمهامه على أحسن وجـه و كـذا إعداد مساحات للتخليص الجمركي مجهزة بتجهيزات و معدات تسمح بالحفاظ على البضائع .

كما أن الوكيل المعتمد لدى الجمارك يجب أن يوسع من مجال تدخله إلى نشاطات أخرى مثل النقل و أن لا يكتفي بمهنة جمركة البضائع لحساب الغير ، إضافة إلى ذلك يجب على الوكيل المعتمد لدى الجمارك و قبل كل شيء أن يكون كفء فـي مجال عمله و هذا من أجل رفع التعاملات .
