جريمة إفشاء السر المصرفي في التشريع

Abstract

تعتبر البنوك عصب الحياة الإقتصادية، ومن أهم المبادئ والقواعد التي فرضتها هي عدم خرق السر المصرفي الذي يعد المرآة العاكسة للسرية في البنك، والإخلال بهذه القاعدة يترتب عليه مسؤولية جزائية والتي يتحملها كل من الموظف والمصرف. يعد موضوع السرية المصرفية من الموضوعات الهامة بالغة التعقيد إذ أنها تثير العديد من المشكلات التي يتسع مداها من الناحيتين القانونية والعملية. تتناول هذه الدراسة جريمة إفشاء السر المصرفي وسيعتمد في الأساس على أسلوب تحليل النصوص التي عالجت السرية المصرفية وفق القواعد العامة في التشريع الجزائري إذ لا يوجد قانون خاص بالسرية المصرفية في الجزائر فالأساس القانوني لالتزام المصارف بعدم إفشاء السر المصرفي في المادة117 من الأمر 03/11 المتعلق بقانون النقد و القرض المعدل والمتمم وهو النص الوحيد الذي تناوله المشرع الجزائري مع التركيز على النص العام وهو نص المادة 301 من قانون العقوبات الجزائري و بيان مدى انطباقه على جريمة إفشاء السر المصرفي.

Note summary in English: Banks are the backbone of economic life and one of the most important principles and rules that they imposed is not violating. The banking secrets which is the mirror of secrecy in the bank. Violation of this rule entails a penal responsibility that is borne by both the employee and the bank. The issue of bank secrecy is one of the most important and complex issues, as it raises many problems that expand its scope from a legal and practical perspective. This study deals with the crime of disclosing banking secrets and will depend mainly on the method of analyzing texts that deal with banking secrecy according to the general rules in Algerian legislation, since there is no law relating to the banks obligation not disclose banking secrets is in Article 117 of ordinance 03/11 relates to the amended and supplemented monetary and loan law with a focus on general text with is the text of Article301 of the Algerian penal code and its applicability to the crime of disclosing banking secrets.
