جريمة النصب في قانون الأعمال

Abstract

إنه من بين الإفرازات الأساسية للعولمة تفاقم نسب الجرائم الاقتصادية والمالية، وتعد جريمة النصب من أهم هذه الجرائم التي تطرق لها المشرع الجزائري في المادة 372 من قانون العقوبات وحدد أنواع وسائل التعليم في اتخاذ الجاني لاسم كاذب أو صفة كاذبة أو مناورات احتيالية وبالرجوع للفقرة 02 نجد أن عقوبة الاحتيال تشدد بمناسبة إصدار أسهم أو سندات أو أوراق مالية أخرى، وتشمل جميع الشركات والمشروعات والمؤسسات التجارية أو الصناعية. وأخيرا رأينا من الضروري التطرق لجريمة الإفلاس بالتدليس التي أصابت مجال الأعمال كله، وأصبحت أشهر دعاوى الشركات التجارية. الكلمات المفتاحية: العولمة، الجريمة، المناورات، الاحتيال، الأسهم، السندات، الشركات، الإفلاس، الاكتتابّ، الأنترنت. Abstract : One of the basic manifestations of globalization is the aggravation of the proportions of economic and financial crimes, and the crime of fraud is one of the most important of these crimes addressed by the Algerian legislator in article 372 of the Penal Code and specified the types of means of education in the perpetrator's false name, false character or fraudulent manoeuvres, and by reference to paragraph 02, the penalty for fraud is increased on the occasion of the issuance of shares, bonds or other securities, including all companies, projects, commercial or industrial institutions. Finally, we felt that it was necessary to address the crime of bankruptcy by fraud that had plagued the entire business area, and had become the most famous commercial enterprise.
