Abstract

تتناول هذه الدراسة موضوع التحكيم في إطار نظام غرفة التجارة الدولية، إذ تعتبر هذه الأخيرة مؤسسة غير حكومية تنشط بفعالية كبيرة في مجال التجارة الدولية لكنها مستقلة بذاتها، تهدف إلى خدمة قطاع الأعمال الدولي و تعزيز التجارة من خلال وضع قواعد موحدة لضبط و تنظيم مجموعة من المسائل أهمها التحكيم كآلية مستحدثة لتسوية النزاعات. تنظم قواعد التحكيم بغرفة التجارة الدولية بمساعدة أجهزتها و لجانها المنبثقة عنها العملية التحكيمية التي تمر بمراحل ابتداء من اتفاق الأطراف باللجوء للتحكيم إلى مرحلة مباشرة الدعوى وصولا إلى صدور حكم منهي للنزاع. Abstract: Thisstudy adresses the topic of arbitration Under the international trade regime, this latter is non govermental organization that is very active in international trade, but it is stand-alone Aims to serve the international business sector and promote, trade by establishing uniform rules to regulatevariely of issures the most important of them is the settlement of disputes. It regulates rules of arbitration in the chamber of commerce with assistance of its organs and committees. thearbitition process is at stages of parties agreement by ressorting to the stage of initiation of proceedings, the arbitral tribunal's decision terminates the settlement dispute.
