الدليل العلمي الالكتروني في القانون الجنائي الجزائري

Abstract

إن اكتشاف الجريمة ومعرفة تفاصيل وقوعها يعتمد على الأدلة، وبظهور الجريمة الإلكترونية ظهر نوع جديد من الأدلة الجزائية هو الدليل العلمي الإلكتروني، وهو عبارة عن مزيج من المعلومات والأرقام التي توجد في الحواسيب والشبكات، و الهدف من دراسة الدليل العلمي الإلكتروني في التشريع الجزائي الجزائري هو البحث في ماهية الدليل العلمي الإلكتروني وعرض اهم إجراءات استخلاصه وجمعه سواء التقليدية منها أو الحديثة، ثم التطرق إلى صعوبات استخلاصه، ثم معرفة سلطة القاضي في تقدير وقبول الدليل العلمي الإلكتروني والاقتناع به في التشريع الجزائي الجزائري. الكلمات المفتاحية: الدليل العلمي الالكتروني، حجية الدليل العلمي، إجراءات استخلاص العلمي

Abstract: The discovery of the crime and knowing the details of its occurrence depends on the evidence, and withe the emergence of electronic crime a new type of penal evidence appeared ,which is the electronic scientific evidence in legislation ,which is a mixture of information and numbers that are found in computer and networks.researching the nature of electronic scientific evidence and presenting and collecting it, whether traditional or modern ,then addressing the most important procedures for extracting and collecting it , then knowing the authority of the judge in evaluating and accepting and accepting electronic scientific evidence and being convinced of it in the Algerian penal legislation.
