Abstract

أفرزت التكنولوجيا نوعا جديدا من التجارة تنشأ في بيئة افتراضية رقمية، تبرم من خلالها عقود الكترونية تتخطى الحدود الجغرافية، مما استوجب وجود جهود دولية لجعل القانون يحيطها بقواعد تضمن حقوق المتعاملين من خلالها، وتضبط إجراءات سيرها. والتجارة الإلكترونية الدولية تواجه مصاعب كثيرة في مسألة تنازع القوانين وتحديد القانون الواجب التطبيق على العقود المبرمة بمناسبتها، مما أدى إلى ظهور اجتهادات فقهية تتمحور حول فكرة تكييف قواعد الإسناد التقليدية في المنهج التنازعي مع التجارة الالكترونية وخصائصها، أو إيجاد قانون موضوعيّ مستقل ينشأ بين متعامليها يتماشى مع متطلباتها، إضافة إلى إيجاد آليات تسوية النزاعات عبر الإنترنت مناسبة لهذا النوع من التجارة.

Summary: Technology has produced a new type of trade that arises in a digital virtual environment, through which electronic contracts are concluded that transcend geographical borders, which necessitated international efforts to make the law surround it with rules that guarantee the rights of dealers through it and control its procedures and international e-commerce faces many difficulties in the issue of conflict of laws determining the law applicable to contracts concluded on its occasion, which led to the emergence of jurisprudence centered around the idea of adapting the traditional attribution rules in the disputed approach to electronic commerce and its characteristics, or finding an independent objective law that arises between its clients on line with its requirements, in addition to finding mechanisms for settling disputes through the internet is suitablefor this type of trade.
