Abstract

إن استخدام مختلف برامج الذكاء الاصطناعي بصفة عامة والمركبات ذاتية القيادة بصفة خاصة، يثير العديد من الصعوبات، لاسيما فيما يتعلق بموضوع المسؤولية عن أضرار المركبات القائمة على البرمجيات ومدى ملاءمة التشريعات الحالية وقدرتها على استيعاب الخصائص الفريدة لهذه الطفرة التكنولوجية. وعليه، فإن هذه الدراسة تهدف إلى التعرف على المركبات ذاتية القيادة بمستوياتها الستة، إضافة إلى معرفة مختلف تحدياتها التنظيمية والقانونية التي تواجهها كونها فكرة مستحدثة طرحت للتجريب على طرقات العديد من الدول، وصولا إلى محاولة معرفة طبيعة الشخص المسؤول عن أفعال هذه المركبات بناءا على مختلف الأسس القانونية التقليدية والحديثة للمسؤولية المدنية، ومختلف الآراء الفقهية أبدت رأيها في هذا الموضوع وتشريعات الدول التي نظمتها على ندرتها.

Abstract: The use of variousartificial intelligence programs and self-drivingvehiclesilluminatesmanydifficulties, especiallywith regard to the issue of liability for damages to software-basedvehicles and the suitability of currentlegislation and itsability to absorb the unique characteristics of thistechnological boom. Accordingly, thisstudyaims to identify self-drivingvehiclesattheir six levels, in addition to knowingtheirvariousregulatory and legal challenges thatthey face as a novelideathat has been put forward for experimentation on the roads of many countries, leading to an attempt to know the nature of the personresponsible for the actions of thesevehiclesbased on variouslegal bases. Traditional and modern civil responsibility, and variousjurisprudential opinions expressedtheir opinion on thissubject and the legislation of the countries thatorganizedit, despiteitsscarcity.
