المنازعات المترتبة عن استغلال العقار الصناعي

Abstract

يشكل العقار الصناعي الرهان الحقيقي لتجسيد السياسة الاستثمارية في الجزائر، ودعم مخططات التنمية الاقتصادية، لذلك سخر المشرع الجزائري ترسانة قانونية كبيرة، عمل من خلالها على تكريس الاستغلال الأمثل للثروة العقارية باعتبارها حافز كبير للاستثمار، وتوجيهها لاحتضان المشاريع الاستثمارية ذات الطابع الصناعي والإنتاجي، بإقامة مناطق صناعية ومناطق للنشاطات، ونظم كيفية استغلالها، بداية باعتماد نظام التنازل والامتياز، إلا أن البيئة الاستثمارية في هذا المجال شهدت حالة عدم الاستقرار، وكثرة النزاعات بسبب التداخل الكبير في النصوص القانونية المنظمة للعقار الصناعي، والتسيير اللاعقلاني لحافظته العقارية، الذي أدى هو الآخر لاستنزافها دون تحقيق الهدف الذي وجدت من أجله. ليحاول المشرع الجزائري من جديد سد جميع الفراغات التي شهدتها النصوص القانونية السابقة، فقصر منح استغلال العقار الصناعي على صيغة وحيدة وهي الامتياز بالتراضي، مع الإبقاء على العقار الصناعي مملوك للدولة والمحافظة عليه من المضاربة والتحويل. الكلمات المفتاحية: العقار، العقار الصناعي، النزاعات القانونية، العقد، المشرع الجزائري. Abstract : Industrial real estate is the real bet to embody the investment policy in Algeria and support economic development plans, so the Algerian legislator harnessed a large legal arsenal, through which he worked to devote the optimal exploitation of real estate wealth as a great incentive for investment, and direct it to embrace investment projects of an industrial and productive nature, by establishing industrial zones and zones for activities, and organizing how to exploit them, starting with the adoption of the system of concession and concession, but the investment environment in this area has witnessed instability, and the abundance of conflicts due to overlap. The great amount of legal texts regulating industrial real estate, and the irrational management of its real estate portfolio, which also led to its depletion without achieving the goal for which it was founded. The Algerian legislator tried once again to fill all the voids witnessed in the previous legal texts, limiting the granting of the exploitation of industrial property to a single formula, namely concession by mutual consent, while retaining the industrial property owned by the state and preserving it from speculation and conversion.
