المنازعات العقارية العامة

Abstract

تثير الملكية العقارية عدة نزاعات, باعتبارها أثمن ما يمكن أن يملكه الشخص طبيعيا كان أو معنويا. و نظرا لأهمتها الكبيرة نظم المشرع الجزائري هذه النزاعات و أولاها أهمية كبيرة. و حماية لحقوق الأفراد و الدولة و حفاظا على النظام العام, فقد منح المشرع الاختصاص للقضاء الإداري في بعض منازعاتها و هو الشق الذي تناولناه في دراستنا للموضوع, أين يتصدى فيه القاضي الإداري للمنازعات العقارية فضلا عن حرفية النصوص احترام قواعد العدالة و الإنصاف. فيمكن للفرد حماية ملكيته الخاصة من تعسف الإدارة بمختلف هيئاتها و اللجوء للقضاء الإداري قصد إلغاء قراراتها و المطالبة بالتعويض هذا من جهة, و من جهة أخرى يمكن للدولة حماية الأملاك الوطنية العامة و الخاصة تحقيقا للصالح العام.

Summary Real estate ownership raises several disputes, as it is the most valuable thing that a person can own, whether natural or legal. In view of their great importance, the Algerian legislator organized these disputes and attached great importance to them. In order to protect the rights of individuals and the state and to preserve public order, the legislator has granted jurisdiction to the administrative judiciary in some of its disputes, which is the part that we discussed in our study of the subject, where the administrative judge addresses real estate disputes as well as the letter of texts respecting the rules of justice and fairness. The individual can protect his private property from the abuse of the administration in its various bodies and resort to the administrative judiciary in order to cancel its decisions and claim compensation on the one hand, and on the other hand, the state can protect public and private national property in order to achieve the public interest
