الحماية القانونية لحقوق المؤلف

Abstract

حق المؤلف من أبرز حقوق الملكية الفكرية، كونه تقوم على الإنتاج الذهني والإبداع الفكري، وما يتولد عنه من مصنفات بمختلف أنواعها وطرق استعمالها، وما يعود عنها للصالح العام من الأفراد وحتى الدول في اقتصادها ونموها الثقافي، ما دفع التشريعات وبما فيها التشريع الجزائري إلى تأمين حماية لكافة المصنفات على أن تتمتع بالأصالة كشرط جوهري، كما وفرت الحماية لمؤلفيها أثناء حياتهم وبعدها لمدة محددة قانونا، واعترفت لهم بمجموعة من الحقوق سواء كانت مادية أو معنوية. ولمنع التعدي على المؤلف وحقوقه أقرت التشريعات آليات لذلك تتمثل في الإجراءات الوقتية لوقف التعدي، ودعوى المسؤولية المدنية للمطالبة بالتعويض العيني أو غير العيني، بالإضافة إلى فرض عقوبات صارمة أصلية وتكميلية تتمثل في الحماية الجزائية وكلها في سبيل الحماية القانونية لحقوق المؤلف. الكلمات المفتاحية:المصنفات - حق المؤلف - الحق الأدبي - الحق المالي - مدة الحماية - الإعتداء - الحماية المدنية - الحماية الجزائية. Summary in English: Copyright is one of the most prominent intellectual property rights, as it is based on mental production and intellectual creativity, and the works generated from it of various types and methods of use, and what is attributed to them in the public interest of individuals and even countries in their economy and cultural growth, which prompted legislation, including Algerian legislation, to secure protection All works provided that they enjoy originality as an essential condition, and also provided protection to their authors during and after their lives for a legally defined period, and recognized for them a set of rights, whether material or moral. In order to prevent infringement of the author and his rights, the legislation approved mechanisms for this, which are temporary procedures to stop the infringement, and civil liability lawsuits to demand compensation in kind or not in kind, in addition to imposing strict original and complementary penalties represented in penal protection, all of which are in the way of legal protection of copyright.
