Abstract

يعتبر الفساد اخطر الجرائم التي تستهدف اقتصاد الدول فهو لا يعرف حدودا سياسية أو جغرافية أو اقتصادية، فلم ينحصر في الدولة ذاتها بل تعداها إلى ما وراء حدودها فأصبح عابرا للقارات، والجزائر بوصفها احد عناصر المجتمع الدولي ومكوناته قامت بمبادرات وجهود جبارة سواء على المستوى الدولي أو على الصعيد الوطني، فعلى الصعيد الدولي انضمت الجزائر إلى جميع الاتفاقيات الدولية الإفريقية والعربية المتعلقة بمكافحة الفساد، أما على المستوى الوطني تم اتخاذ العديد من التدابير والإجراءات وإصدار قوانين حديثة قصد تكريس تلك المعاهدات خاصة اتفاقية الأمم المتحدة لمكافحة الفساد. ويعتبر التشريع الجزائري من بين التشريعات التي سعت جاهدة إلى قمع هذه الجرائم سواء من خلال تلك النصوص المستحدثة التي نظمت هذه الجرائم أو من خلال تلك الميكانيزمات الإجرائية الخاصة التي استحدثها للبحث والتحري والتحقيق، وهذا ما يؤكد رغبة المشرع في القضاء على هذه الجرائم والحد من خطورتها.
