مبدأ المنافسة في القانون الجزائري

Abstract

تعرف حرية المنافسة بأنها تسابق التجار من أجل التفوق والريادة في السوق، وعلى هذا الأساس فإن للعبة التنافسية مبادئ وقواعد تلعب في ظلها، وقيما مثلى يجب الحفاظ عليها. وقد تبنى المشرع الجزائري مبدأين هامين يعدان ركيزة اقتصاد السوق الحر، ولا يمكن بأي حال أن نقول بوجود منافسة من دونهما وهما مبدأ حرية التجارة والصناعة ومبدأ تحرير الأسعار. كما سعى المشرع إلى تأطير قواعد اللعبة التنافسية وحماية قيمها المثلى من الانحراف، من خلال حظر الممارسات الأكثر شيوعا في عالم الأعمال والأكثر انتشارا بين المتنافسين التي قد ينجم عنها خطر المساس بالمنافسة في السوق، وأكثر من ذلك خطر المساس بالاقتصاد العام للدولة. ومع ذلك، يبقى واجبا على السلطات أن توفر المناخ الملائم للمنافسة من خلال وضع سياسة رشيدة للمنافسة وآليات تسمح بدعمها وتنظيمها وضبطها، وعلى رأسها " مجلس المنافسة ". الكلمات المفتاحية: حرية المنافسة ،السوق، الممارسات المقيدة للمنافسة، القانون، غير مشروع.

Abstract Free concurrence isdefined as racingmerchants for excellence and market leadership. On this basis, the free concurrence has principles and rules in which to play, and optimal values must bepreserved.
