Abstract

من خلال دراستنا لموضوع مبدأ المنافسة الحرة في القطاع المصرفي يهدف هذا موضوع الى التعرف على المنافسة الحرة في القطاع المصرفي الجزائري وهل نجحت هذه الأخيرة في فتح المجال أمام المنافسة في هذا القطاع، كما إستخلصنا إلى أن الرقابة على نشاط القطاع المصرفي من أحد أهم الركائز الأساسية التي تقوم عليها المنظومة المصرفية في الجزائر، وذلك راجع إلى صرامة وخصوصية النظام المصرفي، فمن جهة نجد أن المشرع يفتح المجال لدخول رؤوس الأموال إلى الجزائر، ومن جهة أخرى يضع قواعد وضوابط جد صارمة من خلال رقابة البنوك والمؤسسات المالية، رغم أن قواعط المنافسة الحرة تنص على عدم تدخل الدولة أو السلطة العامة وإنسحابها تدريجيا من الحقل الإقتصادي. summary Through our study of the subject of the principle of free competition in the banking sector, we aim to identify free competition in the Algerian banking sector, and whether the latter succeeded in opening the way for competition in this sector. The banking system in Algeria depends on it, and this is due to the strictness and specificity of the banking system. On the one hand, we find that the legislator opens the way for capital to enter Algeria, and on the other hand, he sets very strict rules and controls through the supervision of banks and financial institutions, although the barriers to free competition stipulate that no The intervention of the state or public authority and its gradual withdrawal from the economic field.
