تنفيذ العقد الإلكتروني في التشريع الجزائري

Abstract

من خلال دراستنا تبين أن هناكالتزامات تقع على المورد الإلكتروني قبل تنفيذ العقد الإلكترونيوأثناء تنفيذه، وهو ما نص عليها المشرع الجزائري في النظام القانوني للعقود التقليدية، كما تطرقنا إلى آليات حماية المستهلك الإلكتروني اتجاه تنفيذ العقد الإلكتروني، وما ينطوي تحتها من حماية مدنية تضمن للمستهلك حقوقه في الضمان وحقه في العدول، وهذا ما سعى إليه المشرع الجزائري من خلال النصوص القانونية. أما في إطار الحماية الجنائية أو الجزائية للمستهلك، فتناولنا صور الحماية الجزائية الإلكترونية الواقعة على المستهلك وتعرضهلعمليات الغش والاحتيال في ظل تعامله عبر شبكة الإنترنت، وكذلك بينا أهم العقوبات المقررة لهذه الجريمة، وهي عقوبات مقررة في قانون العقوبات وقانون حماية المستهلك وقمع الغش. الكلمات المفتاحية: العقد الإلكتروني، المورد الإلكتروني، المستهلك، الحماية الجزائية. ABSTRACT: Through our study, it was found that there are obligations on the electronic supplier before the implementation of the electroniccontract and duringitsimplementation, which is stipulated by the Algerian legislator in the legal system of traditionalcontracts, and wealsotouched on the mechanisms of electronic consumer protection towards the implementation of the electroniccontract, and the civil protection that guarantees the consumer his rights to guarantee and his right to justice, and this is what the Algerian legislatorsought through legal texts. Within the framework of criminal or penal protection for consumers, we have dealt with the forms of electronicpenal protection againstconsumers and theirexposure to fraud and fraud in light of theirdealings via the Internet, as well as the most important penalties prescribed for this crime, which are penalties prescribed in the Penal Code and the Consumer Protection and Fraud Suppression Law.
