الحوكمة الرشيدة كآلية لمكافحة الفساد

Abstract

تتمركز دراسة موضوع المندرج تحت عنوان الحوكمة الرشيدة كآلية لمكافحة الفساد لمعرفة مفهوم الفساد الذي أصبح يهدد أمن واستقرار مجتمعاتنا وتحليل العوامل والأسباب المشجعة لظهوره مع ذكر أنواعه ، كما سنوضـح الدور الفعال الـذي تلعبـه إسـتراتيجياتومبادئالحوكـمة الرشـيدةفي محاربــة الفســاد، حيث أنهيعتبرمفهوما مستجدا على الساحة العلمية ، مما جعل اغلب الدارسين والباحثين لعلم السياسة والقانون يختلفون حول مفهومها ما أدى إلى صعوبة إيجاد تعريف موحد للحوكمة ، وهوما سنحاول فهمه في هذه الدراسة من خلال عدة عناصر منها : ماهية الحوكمة ونشأتها وتطورها ، وكذا العوامل المساعدة في ظهورها (إقتصادية واجتماعية وسياسية) ، كما سنتطرق إلى مبادئ ومؤشرات الحوكمة من شفافية ومساءلة ومشاركة ... إلخ ، بالاضافة الى تحديد قواعدها ،أهدافها و معاييرها .. وكذا جهود المنظمات الدولية في إرساء مبادئ الحوكمة من أجل مكافحة الفساد وطرق تفعيل مبادئ الحوكمة في التصدي للفساد،هذا فيما يخص الجانب النظري من الدراسة ،أما الجانب التطبيقي للدراسة فقمت باستعراض كل من التجربة التونسية والجزائرية بالتطرق الإطارالقانوني والمؤسساتي لكل دولة وتوصلت إلى أنها تعتبر تجارب ناجحة من حيث الـتأسيس دون التفعيل وكذا التجربة الماليزية التي صنفت نموذجا ناجحا في التأسيس والتفعيل في إرساء مبادئ الحوكمة الرشيدة لمكافحة الفساد .
