Abstract

في إطار تطهير الملكية العقارية وضمان استقرار المعاملات والمراكز القانونية تبنى المشرع الجزائري نظام الشهر العيني، الذي يعتمد أساسا على عملية المسح العام للأراضي، التي تمر بعدة مراحل، تحضيرية وميدانية، فنية وقانونية، تنتهي بإيداع وثائق المسح لدى المحافظ العقاري المختص إقليميا لتأسيس السجل العقاري، وإنشاء مجموعة البطاقات العقارية وترقيم العقارات ترقيما نهائيا، طبقا للمادة 12 من المرسوم 76/63 المتعلق بتأسيس السجل العقاري، في حالة الملكية الثابتة بسند رسمي مشهر، أو ترقيما مؤقتا طبقا للمادتين13و14 من ذات المرسوم،على أساس الحيازة والمالك الظاهر، وقد يرقم العقار ترقيما مؤقتا لمدة سنتين في حساب المجهول، أو في حساب العقارات الغير مطالب بها أثناء أشغال المسح، بعد صدور القانون 14/10 المتضمن قانون المالية لسنة 2015. وللوصول إلى إعداد دفتر عقاري وتسليمه إلى صاحبه، تمر العملية بمراحل مختلفة ومعقدة تثور بشأنها نزاعات مختلفة باختلاف المرحلة التي تعرفها العملية، ولذلك عمد المشرع إلى وضع نظام قانوني متكامل كفيل بتسوية النزاعات الناشئة قبل وبعد وبمناسبة إعداد الدفتر العقاري، تسوية إدارية أو قضائية، تكريسا لمبدأ العدالة وحماية لحق المالك الحقيقي. الكلمات المفتاحية: الملكية العقارية، الشهر العيني، مسح الأراضي العام، السجل العقاري، البطاقة العقارية، الدفتر العقاري، منازعات الترقيم العقاري.

Abstract : Within the framework of purifying real estate ownership and ensuring the stability of transactions and legal centers, the Algerian legislator adopted the in-kind month system, which relies mainly on the general land survey process, which goes through several stages, preparatory and field, technical and legal, ending with the deposit of survey documents with the regionally competent real estate governor to establish the real estate registry, And the establishment of a set of real estate cards and the final numbering of real estate, in accordance with Article 12 of Decree 63/76 related to the establishment of the real estate registry, in the case of fixed ownership with a publicized official document. Or a temporary numbering in accordance with Articles 13 and 14 of the same decree, based on possession and the apparent owner, and the property may be numbered temporarily for a period of two years in the account of the unknown, or in the account of real estate not claimed during the survey works, after the issuance of Law 10/14 that includes the Finance Law of 2015. In order to reach the preparation of a real estate book and hand it over to its owner, the process goes through different and complex stages in which different disputes arise, depending on the stage the process is known to, and therefore the legislator sought to develop an integrated legal system that guarantees settlement of disputes arising before and after and on the occasion of preparing the real estate book, an administrative or judicial settlement, devoting to the principle Justice and protection of the right of the real owner. key words: Real estate ownership, real estate registration, general land survey, real estate registry, real estate card, real estate book, real estate numbering disputes.
