دور الشرطة العلمية في مواجهة جرائم الأنظمة المعلوماتية

Abstract

تعتبر الجريمة الإلكترونية استعمار حديث للعالم وهذا راجع لتوفر الإمكانية للمجرم الإلكتروني بالإضافة إلى نقص الخبرة لدى العاملين في قطاع أمن المعلومات وكذلك قصور مؤسسات التعليم والمجتمع المدني في القيام بدورهم التوعوي والوقائي في مكافحة تلك الجرائم فقامت الدول بإلقاء المسؤولية على الشرطة العلمية لمحاربة هذه الفئة مع توفير لها الوسائل اللازمة على حسب قدرة الدولة. وكل هذه المجهودات من أجل التوصل إلى حل القضايا ومساعدة القاضي في اتخاذ قراره. ولكن من جهة أخرى يصطدم الواقع بوجود عدة عقبات مما استدعى اللجوء أيضا إلى ضرورة تعديل وإضافة قوانين عقوبيه مستحدثة، ولقد جاءت هذه الورقة البحثية لتسلط الضوء على هذه الإجراءات وتبين أحكامها وضوابطها خاصة إذا عرفنا أنها تنطوي على المساس بحقوق الإنسان وحرياته الأساسية. الكلمات المفتاحية: شرطة , أنترنت ، جريمة ، شرطة علمية ، الشرطةالقضائية ، المراقبةالإلكترونية ، الجريمةالإلكترونية ، النظامالمعلوماتي. Abstract Cybercrime is considered a modern colonization of the world, this is attributed to the availability of the opportunities for the cybercriminals, in addition to the lack of experience among those working in the field of information security. Also, there is the deficiency in educational institutions and civil society in carrying out their educational and preventative roles in combating these crimes. Therefore, countries have placed the responsibility on the scientific police forces to combat this category, providing them with necessary means according to the state’s capacity. All these efforts are aimed at finding solutions to the issues and assisting the judge in making decision. On the other hand, reality collides with the several obstacles, which had led to the necessity of amending and adding new penal laws. This research paper sheds light on these measures, explaining provision and regulation, especially since they involve encroachments on human rights and fundamental freedoms.
