حماية المستهلك من أضرار المنتجات غير المطابقة في القانون الجزائري

Abstract

ملخص يشهد العالم في العصر الحالي نزعة استهلاكية واسعة على إثر التطور الصناعي والتكنولوجيوانتعاش التجارة الدولية، الأمرالذي ساهم بشكل كبير في ظهور منتجات حديثة ومتنوعة تتسم بنوع من التعقيد، وأمام هذا الوضع، أصبح المستهلك عرضة لاستهلاك منتجات غير مطابقةقد تمس بأمنه وسلامته وصحته. ومن أجل ضمان حماية المستهلك من أضرار المنتجات غير المطابقة، عالج المشرع الجزائري هذه المسألة من جوانب قانونية مختلفة، سواء في إطار القواعد العامة في القانون المدني أو في ظل القوانين الخاصة سيما منهاقانون حماية المستهلك وقمع الغش و قانون التجارة الإلكترونية، وكرس من خلالها حماية وقائية للمستهلك من أضرار المنتجات غير المطابقة من جهة، ومن جهة أخرى أقام مسؤولية المتدخل في حالة تضرر المستهلك من هذه المنتجات. الكلمات المفتاحية: المطابقة- المنتجات- الضرر- وقاية المستهلك- مسؤولية المتدخل RESUME: Le monde d’aujourd’hui est témoin du consumérisme qui s’élargisse de plus en plus dû au développement de l’industrie, de la technologie et l’accroissement du commerce international, ce qui a contribué à l’apparition de divers nouveaux produits complexes ; ceci a rendu le consommateur susceptible à la consommation de produits non-conformes qui peuvent toucher sa sécurité et sa santé. Afin de garantir la sécurité du consommateur des produits non-conformes, le législateur algérien a traité cette situation de plusieurs aspects juridiques ; que ce soit dans le cadre de règles générales dans le code civil ou dans le cadre du droit privé, notamment la loi sur la protection du consommateur et la répression des fraudes et la loi du commerce électronique, visant à élaborer des règles sur la prévention de la protection du consommateur des préjudices causés par les produits non-conformes et à établir la responsabilité de l’interventionniste, si le consommateur a été lésé par ses produits. Abstract The contemporary world is witnessing a wide consumerism as a result of the industrial and technological development, in addition to the recovery of international trade, which has contributed greatly to the emergence of modern and diverse products that are characterized by a kind of complexity.Faced with this situation, the consumer has become susceptible to consuming non-conforming products that may affect his security, safety and health. In order to ensure consumer protection from the damages of non-conforming products, the Algerian legislator addressed this issue from various legal aspects, whether within the framework of general rules in civil law or under special laws, especially the Consumer Protection and Fraud Suppression Law and the Electronic Commerce Law, through which he devoted protection A protective measure for the consumer from the damages of non-conforming products on the one hand, and on the other hand, he established the responsibility of the intervening party in the event that the consumer was harmed by these products.
