آليات حماية المحيط العمراني في الجزائر ودورها في تعزيز التنمية المستدامة

Abstract

ينصب موضوع البحث حول اهتمام المشرع الجزائري بحماية المحيط العمراني من خلال ترسانة قانونية وتنظيمية تهدف في مجملها إلى تنظيم وترشيد التوسع العمراني بصفة تضمن استدامته وتحافظ على الجانب الجمالي والانسجام والتنسيق. عالج البحث إشكالية تتعلق في مدى مساهمة آليات حماية المحيط العمراني في تعزيز التنمية المستدامة وذلك باللجوء إلى آليات بإخضاع الأشخاص للشروط البيئية والعمرانية، قصد توفير حماية بشكل يلائم نمط العمران خاصة في المناطق الخاصة. وتوصل البحث إلى أن من أجل تحقيق تنمية عمرانية مستدامة، عمد المشرع الجزائري إلى تبني العديد من الآليات القانونية والتقنية لتنظيم عمليات البناء والتعمير، بالإضافة إلى تعزيز الرقابة القبلية والبعدية على عمليات البناء، كما قامت ببناء مدن جديدة وفق ما يقتضيه مفهوم التنمية المستدامة. الكلمات المفتاحية: البيئة العمرانية، آليات الضبط العمراني، التنمية المستدامة، المناطق الخاصة. SUMMARY: The subject of the research focuses on the interest of the Algerian legislator in protecting the urban environment through a legal and regulatory arsenal that aims in its entirety to organize and rationalize urban expansion in a way that guarantees its sustainability and preserves the aesthetic aspect, harmony and coordination. The research addressed a problem related to the effectiveness of legislative texts and legal means to protect the urban environment from chaotic forms of construction by resorting to mechanisms that subject people to environmental and urban conditions, in order to provide protection in a way that suits the urban pattern, especially in private areas The research concluded that in order to achieve sustainable urban development, the Algerian legislator adopted many legal and technical mechanisms to regulate construction and reconstruction processes, in addition to strengthening tribal and remote control over construction processes. It also built new cities in accordance with what is required by the concept of sustainable development.
