Abstract

تشكل الأراضي الفلاحية الخاصة ثروة اقتصادية هامة لما لها من دور فعال في تحقيق الأمن الغذائي، ونظرا للوظيفة الاجتماعية التي تؤديها في المجتمع فرض قانون التوجيه العقاري 90 - 25 المعدل والمتمم ضوابط تصرف مادية وقانونية على الأراضي الفلاحية الخاصة، إذ ألزم مالك العقار باستغلال أرضه واعتبر امتناعه عن ذلك تعسفا في استعمال الحق، يعرضه إلى جزاءات تصل إلى حد تجريده من ملكيته ، في المقابل وضع قيود تضبط المعاملات العقارية واشترط ضرورة إفراغها في شكل رسمي ضمانا لحمايتها كما ألزم المرسوم التنفيذي 97 - 490 المحدد لشروط تجزئة الأراضي الفلاحية وجوب احترام المساحة المرجعية عند تقسيم الأراضي الفلاحية مهما كان النظام القانوني الذي تخضع له الأرض المعنية حفاظا على طابعها الفلاحي . الكلمات المفتاحية: العقار الفلاحي - حماية الأراضي - ضوابط التصرف .
