رخصة البناء على ضوءآخر تعديل قانوني -دراسة على ضوء المرسوم التنفيذي 24--247

تعتبر الملكية العقارية من الحقوق الممنوحة للمالك وله كامل الحرية في التصرف في هاته الملكية، غير أن المشرع الجزائري قيد هاته الحرية وذلك من خلال القوانين والمراسيم أهمها آخر تعديل وهو المرسوم التنفيذي رقم: 24/247 وهذا من أجل الموازنة بين المصلحة العامة والخاصة.
حيث جعل عملية البناء تخضع وجوبا إلى الحصول على رخصة البناء التي تعتبر من الأدوات الضرورية لحماية ووقاية المجتمع من الأخطار التي قد تنجر عن ممارسة النشاط العمراني بصورة آمنة ومنتظمة، وهاذا للحد من التجاوزات في حركة البناء والتعمير جملة من القيود على عملية البناء.
فأي عملية بناء يجب أن تخضع لمجموعة من المقاييس والقواعد التقنية المحددة والمضبوطة قانونا للنهوض قدما بالنشاط العمراني ومواكبته تكنولوجيا البناء الحديثة

Abstract:
Real estate ownership is considered a right granted to the owner, who has complete freedom to dispose of this property. However, the Algerian legislator has restricted this freedom through laws and decrees, the most important of which is the latest amendment, Executive Decree No. 24/247, in order to balance the public and private interests.
The construction process is subject to obtaining a building permit, which is considered one of the necessary tools to protect and safeguard society from the dangers that may result from practicing urban activity in a safe and regular manner. This is to limit violations in the construction and building movement, and a set of restrictions on the construction process.
Any construction process must be subject to a set of specific and legally regulated technical standards and rules to advance urban activity and keep pace with modern construction technology.

رخص البناء الخاصة في التشريع الجزائري

لقد وضع المشرع الجزائري قواعد لمنح رخصة البناء طبقًا لقانون التهيئة والتعمير والنصوص المنظمة لها، والتي تخضع لها جميع البنايات سواء داخل المناطق المحمية أو الخاصة وخارجها، إذ حدد الشروط التي يجب توفرها في كل طالب رخصة بناء، وأحكام منحها والوثائق الخاصة بطلبها، والجهة المؤهلة قانونًا بمنحها، واشترط القوانين الخاصة بالبناء في المناطق المحمية الحصول على ترخيص مسبق، لذلك وجب معرفة هذه المناطق وما تشمله من مواقع مع تحديد الإجراءات والشروط التي يجب تطبيقها واحترامها للحصول على الترخيص والتي بدونها لا يمكن الحصول على رخصة البناء.
من خلال التطرق لموضوع رخصة البناء في المناطق المحمية يبرز الدور الهام والفعال لرخصة البناء، وما تضمنه من تحكم في مشاريع البناء من خلال قواعد وشروط يجب توفرها في كل طالب رخصة بناء، تقييدًا وحماية لهذه المناطق من زحف الاسمنت ومن عبث الإنسان عن طريق قوانين ذات الصلة غايتها تنظيم العمران مع الحفاظ على التراث الثقافي والتاريخي والثروة الغابية والحيوانية والأوساط الطبيعية والمناظر، على أساس احترام السياسة الوطنية للتهيئة العمرانية.
The Algerian legislator has established rules for granting building permits in accordance with the Urban Planning and Development Law and its governing provisions. These apply to all constructions, whether inside or outside protected or special zones. The law defines the conditions required from every applicant for a building permit, the terms of issuance, the necessary documents, and the authorized body responsible for granting it. For construction in protected areas, prior authorization is required. Therefore, it is essential to identify these zones and the sites they cover, as well as the procedures and conditions that must be followed and respected to obtain the permit, without which construction is not permitted.
Addressing the topic of building permits in protected areas highlights the important and effective role of such permits in regulating construction projects through rules and conditions that each applicant must meet. This ensures control and protection of these areas from concrete encroachment and human misuse through related laws aimed at organizing urban development while preserving cultural and historical heritage, forests, wildlife, natural environments, and landscapes, all based on respect for the national urban planning policy.
دور الرقمنة في مكافحة الفساد الاداري

تعتبر الرقمنة خطوة هامة في تحسين أداء المرافق العامة وتعزيز مبدأ المساواة، حيث تتيح الولوج السهل والسريع للمعلومات، وتقلل من الجهد والتكاليف. كما أنها تمكن الأفراد من الحصول على المعرفة والمعلومات بسهولة، وتتيح لهم طباعتها عند الحاجة. ومن جهة أخرى، يعد الفساد الإداري مشكلة عالمية تؤثر على العديد من الدول، وتشمل ممارسات غير قانونية وغير أخلاقية من قبل الأفراد في مواقع السلطة.
وبفضل التوقيع الإلكتروني والرقابة الإلكترونية يمكن مواجهة الفساد وضمان نزاهة الوثائق والمعاملات الرقمية. ومع ذلك، تواجه عملية التحول الرقمي تحديات متعددة تشمل البنية التحتية، إدارة التغيير، والتدريب والوعي، إلى جانب معوقات إدارية، أمنية، مالية وتقنية. يجب وضع استراتيجيات فعالة وتوفير الموارد اللازمة للتغلب على هذه التحديات.

"Digitizationisconsidered an important step in improving the performance of public utilities and promoting the principle of equality, as itprovideseasy and quick access to information, reducing effort and costs. On the other hand, administrative corruption is a global problemthat affects many countries, involvingillegal and unethical practices by individuals in positions of power. Thanks to electronic signatures and electronic surveillance, corruption can beconfronted and the integrity of digital documents and transactions can beguaranteed. However, the digital transformation process faces multiple challenges, including infrastructure, change management, training and awareness, as well as administrative, security, financial, and technical obstacles. Effective strategiesneed to be put in place and necessaryresourcesprovided to overcomethese challenges."

تناولنا في هذه الدراسة المفهوم العام و القانوني لشهادة التعمير و أهم ما جاءت به القوانين و التنظيمات و المراسيم التنفيذية التي أشارت إلى شهادة التعمير و أعطت الأهمية القانونية لهذه الشهادة بحيث اعتبرت من أهم الوثائق القانونية و الإدارية المنظمة لعمليات البناء و التعمير في الجزائر كما أنها تساهم و تركز على دورها في حماية النظام العمراني بحماية المجال البيئي و حماية الأراضي الغير قابلة للتعمير و المجال العمراني من خلال ضمان التوازن بين التنمية العمرانية و احترام المخططات التنظيمية و التوجيهية.

Abstract :
In this study ;we addressed the general and legal concept of the certificate and the main issues discussed by laws ,regulation ;and executive decrees that referred to the certificate and granted it legal significance ,this certificate is considered one of the most important legal and administrative documents governing construction and urbanization processes in Algeria , it also contributes to protecting the system of urban planning and focuses on its role in safeguarding the urban environment , protecting unbuildable lands ,and the urban domain ,by ensuring a balance between urban development and adherence to regulatory and directive plans
