تشديد و تخفيف العقوبة في جرائم المضاربة غير المشروعة

Abstract

تعتبر المضاربة غير المشروعة من الممارسات التجارية التي تضر بالاقتصاد الوطني و استقرار السوق من جهة، و من جهة أخرى بالمستهلك، فبعد استفحال هذه الظاهرة كان لزاما على المشرع الجزائري التدخل، فاستحدث قانونا جديدا خاصا و هو القانون 21-15، و الذي جاء من خلاله بآليات ردعية تمثلت في تشديد العقوبة، من خلال اقترانها بظروف مشددة تزيد من خطورة الفعل الإجرامي أو ذنبه،‎إضافة لاعتماد سياسة تخفيف العقوبة كنوع آخر من الردع،أين يمكن للقاضي أن ينزل فيها عن الحد المقرر قانونا لعقوبة هذه الجريمة الكلمات المفتاحية:المضاربة غير المشروعة، ظروف الجريمة، تشديد العقوبة، تخفيف العقوبة. ABSTRACT : illegal speculation is considered among the illegal and unfair commercial practices which harm the nationale economy and the stability of the markets on the one hand,and on the other hand the consumer. And after the spread of this phenomenon in society it was necessary for the algerianligislator to intervene indeed it issued a special law NO21/15 relating to the fight against illegal speculation. This law came with deterrent mechanism which was to tighten the penalty by coupling it with aggravating circumstances that increase the seriousness of the criminal act, in addition to adopting a policy of reducing the penalty as another form of deterrence where can the judge go below the legally prescribed limit for this crime Key words: illegal speculation, circumstances of the crime, severe punishment, Reducing the penalty
