حجب المواقع الإلكترونية بين الحرية و القانون

Abstract

تهدف هذه الدراسة والموسومة بعنوان حجب المواقع الإلكترونية بين الحرية والقانون إلى استعراض الأبعاد القانونية والاجتماعية لحجب المواقع الإلكترونية، وتقديم تحليل شامل لمبرراته وتداعياته على حرية التعبير. ، وقد تم الاعتماد في هذه الدراسة على المنهج الوصفي، وكذا الاعتماد بشكل أكبر على التحليل كونه موضوع لم يتطرق إليه كثيرا إلا في الصحافة والمواقع الإلكترونية مع أجبرني على الاعتماد بشكل كبير على الأمثلة من أجل الوصول لإجابة مقنعة للإشكالية المطروحة وكذا طرح توصيات تساعد في إثراء الموضوع. وقد توصلت الدراسة إلى عدة نتائج أهمها ضرورة إيجاد التوازن بين حماية الأمن القومي وضمان حرية التعبير، أي إجراءات حجب يجب أن تكون مبررة بشكل واضح وتنفذ بشفافية لمنع الانتهاكات المحتملة للحقوق الأساسية. بالإضافة إلى أن حجب المواقع الإلكترونية لأسباب سياسية يمكن أن يؤدي إلى قمع الأصوات المعارضة والحد من التدفق الحر للمعلومات، مما يهدد المبادئ الديموقراطية وحقوق الإنسان. الكلمات المفتاحية : المواقع الإلكترونية، حجب المواقع الإلكترونية، الأنترنت، حرية التعبير، الصحافة، القوانين الدولية، القوانين الوطنية، الميثاق الإفريقي، الميثاق العربي.
