إن البناء الفوضوي ظاهرة تعاني منها كل الدول، والتي تعرف إنتشارا أوسع في الدولالنامية، حيث تنعكس سلبا على جميع المجالات. بهدف وضع حد والقضاء على ظاهرة البناء الفوضوي الذي يشوه الطابع الجمالي للنسيجالعمراني عبر كامل التراب الوطني، اعتمد المشرع الجزائري على مجموعة من الآليات والقوانين لحماية الطابع العمراني للمدن الجزائرية. رغم كل هذا إلا أنه لم يتوقف البناء الفوضوي بل ازدادت انتشارا، وذلك راجع لعدة أسباب كنقص الإعلام، وعدم وجود بدائل للقضاء على البناء الفوضوي كالبيع بالتجزئة، والحد من المضاربة العقارية التي أدت إلى إرتفاع قيمة العقار، وعدم إحترام رخصة البناء، بالإضافة إلى ضعف قوانين التهيئة والتعمير وضعف الإدارة على تطبيقه. الكلمات المفتاحية: البناء الفوضوي، آليات وقانونية، البيع بالتجزئة، رخصة البناء، التهيئة والتعمير، المضاربة العقارية. Abstract: Anarchyis a phenomenonthat all countries sufferfrom, and whichis morewidespread in developing countries, as itreflectsnegatively on all areas. With the aim of putting an end to and eliminating the phenomenon of chaoticconstruction thatdistorts the aestheticcharacter of the urbanfabricacross theentire national territory, the Algerian legislature has relied on a set ofmechanisms and laws to protect the urbancharacter of Algerian cities. Despite all this, the chaotic construction did not stop, but ratheritspread, butseereasonssuch as the lack of information, the lack of alternatives to chaoticconstruction, such as selling, the limitation of real estatespeculationthatincreases the value of the property, the lack of respect for the buildingpermit, in addition to the weakness of the laws of preparation andreconstruction and weakness of management On its application.
