اعتمد المشرع الجزائري الامتياز كنمط حصري ووحيد الاستغلال والاستثمار في الأراضي الفلاحية التابعة لأملاك الدولة، محاولا بذلك تدارك النقائص والاختلالات الواردة بالأطر والتنظيمات القانونية السابقة، حيث يمنح للمستثمر من خلال الامتياز حق عيني عقاري مؤقت قابل للتجديد كل 40 سنة ، وهذا ما يمكن المستثمر ذاته من استغلال الأرض استغلالا أمثلا محافظا على وجهتها الفلاحية، مما يسمح بتطوير قدراتها الإنتاجية وتحقيق الأمن الغذائي الوطني وفق رؤى مستقبلية مستدامة. الكلمات المفتاحية: حق الامتياز ، المستثمر، الأمن الغذائي، عقد الامتياز. Abstract : The Algerian legislator adopted the concession as an exclusive and single-use and investment pattern in the agricultural land of state property, thereby trying to remedy the shortcomings and imbalances contained in previous legal frameworks and regulations, where the investor is granted through the concession a temporary real estate right renewable every 40 years, which enables the investor himself to optimize the exploitation of the land to maintain its agricultural destination, allowing the development of its productive capacity and the achievement of national food security in accordance with sustainable future visions.
