يعد موضوع جرائم بطلقات الائتمان الإلكترونية من المواضيع الحساسة نظرا لما يثيره من إشكالات قانونية لكونه ينصب على نوع من الجرائم المستحدثة التي ارتبط وجودها بتطور تكنولوجيا المعلومات والحاسبات الآلية. حيث شهدت هذه الجرائم اختلافات فقهية وقضائية في تكييف مختلف الاعتداءات التي من الممكن أن تقع عليها في ظل غياب النصوص التشريعية قانونية صريحة تجرم هذا الفعل، إلا أن قيام المسؤولية الجزائية لا يأتي من فراغ، وإنما يحتاج إلى آليات تساهم في قيامها ومن ثم توقيع الجزاء. الكلمات المفتاحية: الجرائم الإلكترونية ، المسؤولية الجزائية، المسؤولية المدنية، بطاقة الائتمان. Abstract : The subject of e-credit shooting offences is a sensitive topic because of the legal problems it raises because it focuses on the kind of new crimes whose existence has been linked to the development of information technology and computers. These crimes have witnessed differences in jurisprudence and jurisprudence in adapting the various attacks that may occur in the absence of explicit legal legislative texts criminalizing this act, but the establishment of criminal responsibility does not come from a vacuum, but needs mechanisms to contribute to its establishment and thus the imposition of a penalty.
