يُعد قرار الهدم في التشريع الجزائري من الآليات القانونية المهمة لتنظيم النشاط العمراني ومكافحة المخالفات في مجال البناء والتعمير. يهدف هذا القرار إلى إزالة البنايات غير المرخصة أو التي تم إنجازها خارج الإطار القانوني أو دون احترام المخططات العمرانية. وقد نظّم القانون رقم 08-15 المتعلق بمطابقة البنايات وأحكام التعمير إجراءات الهدم، مانحًا للسلطات الإدارية المختصة صلاحية إصدار قرارات الهدم والتنفيذ الجبري لها عند الاقتضاء. كما يشترط القانون احترام الإجراءات القانونية من إعذار مسبق ومهلة للتسوية قبل مباشرة الهدم، ضمانًا لحقوق الأفراد. ويُعدّ القرار أداة فعالة لحماية المجال العمراني والبيئة ومنع العشوائية في التوسع العمراني، بما يسهم في تحقيق التنمية المستدامة والتوازن المجالي. الكلمات المفتاحية: قرار الهدم، النشاط العمراني، النظام العام العمراني، الجزاء الإداري Abstract : In Algerian law, the demolition order is an important legal mechanism for regulating urban activity and combating violations in the field of construction and building. This order aims to remove unlicensed buildings, those constructed outside the legal framework, or those that do not comply with urban plans. Law No. 08-15 on the conformity of buildings and urban planning regulations regulates demolition procedures, granting the competent administrative authorities the power to issue demolition orders and enforce them when necessary. The law also requires compliance with legal procedures, including prior notice and a settlement period before demolition, to guarantee individual rights.
