خص المشرع الجزائري الأملاك الوطنية العمومية بحماية خاصة صارمة ومتنوعة تقتضيها طبيعتها القانونية باعتبارها أموال مخصصة للمنفعة العامة، و بذلك تختلف عن الأموال الخاصة للأفراد وكذلك عن الأملاك الوطنية الخاصة، وبتعدد أوجه الحماية المقررة للأموال العمومية، تتعدد الأخطار التي قد تتعرض لها فقد يكون مصدرها سوء ادارة المال العام أو اهماله، أو التصرف فيه بصورة غير شرعية. وقد يكون مصدر هذه الأخطار الجمهور المستعمل عن طريق شغل الاموال العمومية بطرق غير مشروعة، أو وضع اليد عليها لمدة طويلة، أو الحجز عليها، أو الحاق أي ضرر بها قد يعرضها للاندثار أو التلف. و لذا كفلها المشرع بحماية ادارية وأخري جنائية. Summary : The Algerian legislatorsingled out the national public propertywith a strict and variedspecial protection required by itslegal nature as fundsallocated for the public benefit, and thusdiffersfrom the privatefunds of individuals as well as from the private national property, and with the multiplicity of aspects of protection established for public funds, the dangers to whichtheymaybeexposedmaymultiply. Its source ismismanagement or neglect of public funds, or illegaldisposal of it. And the source of these dangers maybe the public used by illegallyoccupying public funds, seizingthem for a long time, seizingthem, or causingany damage to themthatmay expose them to extinction or damage. Therefore, the legislatorguaranteedit administrative and criminal protection.
