Item المسؤولية الجزائية للشخص المعنوي عن جرائم التلوث الصناعي(مكتبة كلية الحقوق و العلوم السياسية جامعة محمد البشير الابراهيمي برج بوعريريج, 2026-02-16) بن زغيبة عبد الحميد; مقدمي عبد الحقتوصلت الدراسة إلى أن جرائم التلوث الصناعي تتميز بخصائص فريدة تجعلها تختلف عن الجرائم التقليدية، وأن النظم القانونية الحالية تواجه تحديات جوهرية في إثبات المسؤولية الجزائية للأشخاص المعنوية بسبب تعقد العلاقة السببية وصعوبة تحديد القصد الجنائي. كما أظهرت الدراسة قصوراً في آليات الإثبات وعدم كفاية العقوبات المطبقة لتحقيق الردع المطلوب. وقدمت التوصيات تطوير قوانين متخصصة وإنشاء محاكم بيئية وتعزيز التأهيل القضائي المتخصص وتطوير أساليب التحقيق، مؤكدة أن تحقيق مساءلة جزائية فعالة يتطلب إصلاحاً شاملاً للنظم القانونيةوالإجرائية لمواكبة التحديات البيئية المعاصرة. باللغة الأجنبية: The study concluded that industrial pollution crimes are characterized by unique characteristics that distinguish them from traditional crimes. It also concluded that current legal systems face fundamental challenges in proving the criminal liability of legal entities due to the complexity of the causal relationship and the difficulty of determining criminal intent. The study also revealed shortcomings in evidentiary mechanisms and the inadequacy of applicable penalties to achieve the desired deterrence. Recommendations were made to develop specialized laws, establish environmental courts, enhance specialized judicial training, and develop investigative methods. It emphasized that achieving effective criminal accountability requires a comprehensive reform of legal and procedural systems to keep pace with contemporary environmental challenges.
