لقد تبنى المشرع الجزائري من خلال قانون الإجراءات المدنية والإدارية، طرقا بديلة لحل النزاعات التجارية، وهي الوساطة والصلح والتحكيم، حيث نظمها المشرع تنظيما موضوعيا وإجرائيا مبينا إجراءات كل منهم وطرق اللجوء إليهم فاللجوء إلى هذه الطرق البديلة يعتبر طريقا وديا لتسوية النزاع، ويرتكز على رغبة وموافقة الأطراف المتنازعة للوصول إلى حل ودي للنزاع وتجنب اللجوء إلى القضاء وما تحمله طياتها من تعقيد في الإجراءات وتضييع الوقت. الكلمات المفتاحية: وسائل بديلة، الوساطة، الصلح، التحكيم، الحل الودي. Résumé The Algerian legislator, through the Civil and Administrative Procedures Code, has adopted alternative methods for resolving commercial disputes, namely mediation, conciliation and arbitration. The legislator organized them objectively and procedurally, indicating the procedures for each of them and the ways to resort to them. Resorting to these alternative methods is considered an amicable way to settle the dispute, and is based on the desire and agreement of the conflicting parties to reach an amicable solution to the dispute and avoid resorting to the judiciary and the complexity of the procedures and waste of time that it entails. key words: Alternative means, mediation, conciliation, arbitration, amicable solution. .
