Item الآليات القانونية لحماية الأراضي الفلاحية الخاصة من مخاطر التعمير(مكتبة كلية الحقوق والعلوم السياسية جامعة محمد البشير الإبراهيمي برج بوعريريج, 2024-12-11) بوسنة, شفيقة; بن مقال, نعناعةتشكل الأراضي الفلاحية الخاصة ثروة اقتصادية هامة لما لها من دور فعال في تحقيق الأمن الغذائي، ونظرا للوظيفة الاجتماعية التي تؤديها في المجتمع فرض قانون التوجيه العقاري 90 - 25 المعدل والمتمم ضوابط تصرف مادية وقانونية على الأراضي الفلاحية الخاصة، إذ ألزم مالك العقار باستغلال أرضه واعتبر امتناعه عن ذلك تعسفا في استعمال الحق، يعرضه إلى جزاءات تصل إلى حد تجريده من ملكيته ، في المقابل وضع قيود تضبط المعاملات العقارية واشترط ضرورة إفراغها في شكل رسمي ضمانا لحمايتها كما ألزم المرسوم التنفيذي 97 - 490 المحدد لشروط تجزئة الأراضي الفلاحية وجوب احترام المساحة المرجعية عند تقسيم الأراضي الفلاحية مهما كان النظام القانوني الذي تخضع له الأرض المعنية حفاظا على طابعها الفلاحي . الكلمات المفتاحية: العقار الفلاحي - حماية الأراضي - ضوابط التصرف . Abstract: Private agricultural lands constitute an important economic wealth because of their effective role in achieving food security, and in view of the social function they perform in society, the amended and supplemented Real Estate Directive Law 90 - 25 imposed physical and legal controls on private agricultural lands, as it obligated the property owner to exploit His land and his refusal to do so was considered arbitrary in the use of the right, exposing him to penalties that amount to stripping him of his ownership،On the other hand, he set restrictions controlling real estate transactions and stipulated the necessity of emptying them in an official form to ensure their protection, and Executive Decree 97 - 490 specifying the conditions for dividing agricultural lands obligated the necessity of respecting the reference area when dividing agricultural lands, regardless of the legal system to which the land in question is subject, in order to preserve its agricultural character .
