Abstract The issue of bankingsecrecyis one of the important topics related to modern economicsystems, because of the effective roleplayed by banks in social life as a basic axis on whichcredit, financing commercial projects and various services thatbenefit society as a whole. Banking secrecyis a verycomplex issue. Becauseit poses manyproblems, the scope of whichiswidefrom a legal and practical point of view. This studyfocuses on the crime of disclosingbankingsecrecy in Algerian legislation, and willbebasedmainly on the method of analyzingtextsthat deal withbankingsecrecy in accordance with the generalrules of Algerian legislation, becausethereis no speciallaw on bankingsecrecy in Algeria with a focus on the generaltext, whichis the text of 301 of the Algerian Penal Code, and a statement of its application to the banking secret.
