لقد نظم المشرع الجزائري إفلاس الشركات التجارية في القانون التجاري في المواد 215 إلى 388. دون أن يفردها بأحكام خاصة نظرا لخصوصيتها كشخص معنوي باعتبارها مؤسسة في وضعية صعبة. بل طبق عليها نفس أحكام التاجر الشخص الطبيعي من حيث الشروط و الإجراءاتو هو الأمر الذي يستوجب التعريج على خصوصيات إفلاس الشركات التجارية و تحديد الضوابط الخاصة بها، كما يستلزم تحديد جميع الآثار التي تنتج عن إفلاس الشركات و تمتد للشركاء فيها بما في ذلك الكشف عن مدى مسؤولية القائمين بالإدارة عن ديون الشركة المفلسة. الكلماتالمفتاحية: الشركات التجارية، الإفلاس، الدائنون، القائمون بالإدارة، المسؤولية. Abstract: The Algerian legislator has regulated the bankruptcy of commercial companies in the commercial law in Articles from 215 to 388, without singling them out with special provisions due to their privacy as a legal person, since they are institutions in a difficult situation. Rather, the same provisions of the merchant, the natural person, are applied to them in terms of conditions and procedures. This necessitates clarifying the specificities of the bankruptcy of commercial companies and determining the conditions controlling them. It also requires identifying all the effects of the bankruptcy of companies. These effects are not limited to the companies but also extend to the partners, including disclosure of the extent of the responsibility of those in charge of the Debts of the bankrupt company.
