من بين الشركات نجد شركة المساهمة التي قام المشرع الجزائري بإعطائها أهمية كبيرة باعتبارها أهم نوع من أنواع شركات الأموال, وقد قام بنص مجموعـة مـن القوانين لتسيير وتنظيم شركة المساهمة، خصوصا فيما يتعلق بتأسيسها سواء كان التأسيس باللجوء العلني للادخار أو التأسيس الفوري وقام بوضع مجموعة من الجزاءات جراء الإخلال بإجراءات التأسيس، وكذلك كل ما يتعلق بإدارتها ومجالسها التي تعتبر الأساس في تسييرها وتنظيمها, ومن خلال وجود جمعيات عامة لتسييرها، وشركة المساهمة كغيرها من الشركات تنقضي لأسباب عامة وخاصة من بينها انخفاض عدد الشركاء عن الحـد القـانوني أو فيحالة خسارة الشركة.
