يعتبر الفساد من الظواهر التي تواجه الدول وخاصة الدول النامية، فهو بذلك ظاهرة عالمية وعامل قلق للمجتمع الدولي، ذلك أنه يصيب مفاصل حيوية ومؤثرة في الدولة مما يؤدي إلى تفكك الاقتصاد وتهديد الاستقرار الوطني والأمن والسلم الاجتماعي. وعلى هذا الأساس تبنت الدولة الجزائرية استراتيجية مغايرة لمكافحة الفساد تتماشى مع التطورات الراهنة من خلال المصادقة على اتفاقية الأمم المتحدة لمكافحة الفساد والتي جرم بموجبها أفعال الفساد وأقر سياسة جنائية لمواجهتها. عالجت هذه الدراسة جرائم الفساد والآليات المؤسساتية للكشف عنها وكذا مختلف الأحكام الإجرائية التي تفضي إلى المتابعة الجزائية لها ابتداء من مرحلة التحقيق إلى غاية محاكمة مرتكبيها وتسليط العقوبات عليهم. الكلمات المفتاحية: الفساد، الآليات المؤسساتية، تحقيق، دعوى عمومية، متابعة جزائية، عقوبات. Study Summary: Corruption is considered one of the phenomena facing countries, especially developing countries, so it is global phenomenon and a factor of concern for the international community, as it affects vital and influential joints in the state, which leads to the disintegration of the economy and threatens national stability, security and social peace. On this basis , the ALGERIA state adopted a different strategy to combat corruption in line with current developments through the ratification of the united nations convention against corruption , according to which acts of corruption were criminalized and a criminal policy was approved to confront then this study dealt with corruption crimes and the institutional mechanisms to detect them, as well as the various procedural provisions that lead to penal follow- up , starting from the investigations stage until the perpetrators are prosecuted and punished. key words : corruption - institutional mechanisms - investigation- public lawsuit -criminal follow- up – penalties.electronic payment system
