يعتبر التحكيم الإلكتروني وسيلة بديلة لفض المنازعات التجارية ، فقد نظم المشرع الجزائري أحكامه في قانون التجارة الإلكترونية و قانون الإجراءات المدنية و الإدارية . و هو يوفر الجهد و الوقت و يتميز بالسرعة ، يبدأ بإتفاق التحكيم الذي يكون بواسطة محكمين ذوي خبرة عالية في مجال التجارة الإلكترونية . يختارهم الخصوم ، ويتم التحكيم الإلكتروني وفقا لإجراءات معينة بداية من إتفاق التحكيم إلا صدور الحكم و تنفيذه و الإعتراف به ، كل هذا يتم بشكل إلكتروني، فتظهر فاعلية الطرق البديلة لتسوية المنازعات بالتحديد في المفاوضات الإلكترونية و الوساطة الإلكترونية و خاصة التحكيم الإلكتروني الذي يعد لحد الساعة أكثر الوسائل ملائمة لتسوية تلك المنازعات . Summary: In English: Electronic arbitration is considered an alternative means of resolving commercial disputes. The Algerian legislator has organized its provisions in the Electronic Commerce Law and the Civil and Administrative Procedures Law. It saves effort and time and is characterized by speed. It begins with the arbitration agreement, which is made by highly experienced arbitrators. In the field of electronic commerce, the opponents choose them, and electronic arbitration takes place according to certain procedures, starting from the arbitration agreement until the issuance of the award, its implementation, and its recognition. All of this is done electronically, so the effectiveness of alternative methods for settling disputes appears specifically in electronic negotiations, electronic mediation, and especially electronic arbitration.
