السجل التجاري الالكتروني في التشريع الجزائري

أصدر المشرع جملة من القوانين والمراسيم بهدف تهيئة بيئة رقمية مناسبة لممارسة التجارة الإلكترونية، من خلال العمل على عصرنة قطاع التجارة، لاسيما ما يتعلق بالسجل التجاري بالنظر إلى دوره الإحصائي، الاقتصادي والإشهاري، وقد دفعنا هذا التوجه إلى البحث في مدى تنظيم المشرع لقواعد السجل التجاري الإلكتروني، خاصة وأنه أصبح يمثل تشفيرا ضمن النظام المعلوماتي الخاص بالمركز الوطني للسجل التجاري. ويأتي هذا في سياق صدور القانون رقم 18-05 المتعلق بالتجارة الإلكترونية، والذي ساهم بشكل فعّال في تجسيد التوجهات التشريعية المتعلقة بالسجل التجاري، من بينها القانون رقم 18-04 المتعلق بشروط ممارسة الأنشطة التجارية، المعدل والمتمم، والذي أسفر عن إصدار المرسوم التنفيذي رقم 18-112 المحدد لنموذج مستخرج السجل التجاري الصادر عن طريق إجراء إلكتروني، المعدل والمتمم بدوره، وقد أقر هذا المرسوم إلزامية مطابقة سجلات التجار غير الحائزين على الرمز الإلكتروني، وهو ما يجعل الالتزام بالسجل التجاري الإلكتروني ضرورة تجارية لا مفر منها. الكلمات المفتاحية: التجارةالإلكترونية، السجل التجاري ، المركزالوطنيللسجلالتجاري Abstract The legislator has enacted a series of laws and decrees aimed at creating a suitable digital environment for practicing e-commerce, by modernizing the trade sector, particularly with regard to the commercial register, given its statistical, economic, and publicity roles. This legislative trend has prompted us to explore the extent to which the legislator has regulated the rules of the electronic commercial register, especially as it has become an integral part of the information system managed by the National Center of the Commercial Register. This comes in the context of the enactment of Law No. 18-05 related to e-commerce, which has significantly contributed to the implementation of legislative orientations concerning the commercial register. Among them is Law No. 18-04 on the conditions of conducting commercial activities, as amended and supplemented, which led to the issuance of Executive Decree No. 18-112 determining the model of the commercial register extract issued through an electronic procedure, also amended and supplemented. This decree established the obligation for traders without an electronic code to conform their records, making adherence to the electronic commercial register an unavoidable commercial necessity.
