تعتبر عقوبة الإعدام من أخطر العقوبات وأشدها على الإطلاق، لأنها تفقد الإنسان أثمن قيمة يحاول الحفاظ عليها وهي حقه في الحياة. وقد أثير جدل فقهي وقانوني حول ضرورة إلغاء هذه العقوبة في مختلف التشريعات الوطنية، وهذا ماعملت عليه أغلب الإتفاقيات والمنظمات الدولية. تركز دراستنا على عقوبة الإعدام في القانون الجزائري وموقف المشرع الجزائري بين الشريعة الإسلامية والإتفاقيات الدولية. Abstract. The death penalty is considered one of the most serious and most severe punishment, because it loses the most precious value that it tries to presrve. It is considered the right to life. A jurisprudential and legal controversy has arisen about the ne-cessity of abolishing this penalty in the different legislation, this is what most of the international conventions and organization have worked to consolidate. Our study focuses on the death penalty in Algerian law, and the position of Algerian legislator between Islamic and international conventions.
