يعد التراث العمراني الشاهد الأكبر على حضارات الأمم وثقافات الشعوب ورمزا لتطورها، ويمثل قيمة حقيقية له وللأجيال المتعاقبة ورغم هذه الأهمية إلاّ أن هذه الثروة بدأت تفقد هويتها. والجزائر تعتبر دولة غنية بثروات عمرانية هائلة ما حفزها في السعي لتوفير حماية لهذا الموروث العمراني، إما بوضعه ضمن نظام معين ( الحماية الادارية ) أو في تجريم العديد من السلوكيات، وفرض مقابل ارتكابها جملة من العقوبات( الحماية الجزائية ). وقد تناولتهذه الدراسة الآليات القانونية لحماية التراث العمراني في التشريع الجزائري من خلال تحليل مختلف النصوص القانونية التي تضمنها قانون98/04 المتعلق بحماية التراث الثقافي . Summary: The urban heritage is the greatest witness to the civilizations of nations and cultures of peoples and a symbol of their development and represents a real value for him and for successive generations, and despite this importance, this wealth has begun to lose its identity. Algeria is a country rich in enormous urban wealth, which motivated it to seek to provide protection for this urban heritage, either by placing it within a specific system (administrative protection) or in criminalizing many behaviors and imposing a set of penalties (penal protection). Our workshop dealt with the legal mechanisms for the protection of urban heritage in Algerian legislation by analyzing the various legal texts included in Law 98/04 on the protection of cultural heritage.
