تلعب أدوات التعمير دورا كبيرا في مجال التعمير أن قواعد التهيئة والتعمير تنظم العمران ونظرا لظهور العديد من المشاكل التي أثرت سلبا على الجانب الجمالي العمراني وعلى الجانب البيئي، مما أدى بالمشرع الجزائري لتفعيل دور هذه الأدوات في مجال حماية البيئة العمرانية واستحداثه مجموعة من الآليات لتدعيم هذا الدور وتتمثل هذه الآليات في كل من المخطط التوجيهي للتهيئة والتعمير ومخطط شغل الأراضي، بغية تنظيم عملية التهيئة والتعمير والتي أكدت قصورها في مجال ضبط المجال العمراني. حيث تهدف هذه الدراسة إلى تبيان دور أدوات التعمير ممثلة في المخطط التوجيهي للتهيئة والتعمير ومخطط شغل الأراضي في ضبط مجال التعمير، والتي أكدت عدم فعاليتها في مجال حماية الجانب الجمالي العمراني والجانب البيئي وهذا كله راجع الى ضعف السلطات على المستوى المحلي وعدم كفاءتها بالإضافة إلى نقص الوعي لدى المواطنين. الكلمات المفتاحية: مخططات التهيئة، حماية البيئة، قانون التعمير، العدالة العمرانية. Abstract : Reconstruction tools play a major role in the field of reconstruction, as the rules of preparation and reconstruction regulate urbanization and due to the emergence of many problems that have negatively affected the urban aesthetic aspect and the environmental aspect, which led the Algerian legislator to activate the role of these tools in the field of protection of the urban environment and developed a set of mechanisms to strengthen this role, which are represented in both the guideline for preparation and reconstruction and the land occupancy plan, in order to organize the process of preparation and reconstruction, which confirmed its shortcomings in the field of urban control. This study aims to demonstrate the role of reconstruction tools represented in the development and reconstruction guideline and the land occupancy plan in controlling the field of reconstruction, which confirmed its ineffectiveness in protecting the urban aesthetic and environmental aspects, all due to the weakness and inefficiency of the authorities at the local level, as well as the lack of awareness among citizens.
