أقر المشرع الجزائري حق العدول, كآلية قانونية لحماية المستهلك، باعتباره الطرف الضعيف في العلاقة التعاقدية، إذ يعد المبرر الرئيسي لإقرار هذا الحق هو الخبرة والمعرفة التي يتمتع بها المورد على عكس المستهلك. يرد على حق العدول آثار على المورد والمستهلك، فالمستهلك ملزم برد السلعة، والمورد ملزم برد الثمن، وينقضي إما بممارسته في المدة المحددة، أو بفوات المدة المحددة. الكلمات المفتاحية: حق العدول، العقد الالكتروني، المستهلك. Abstract: The Algerian legislator has recognized the right to withdraw as a legal mechanism to protect the consumer,as the weaker party in the contractual relationship, the primary justification for establishing this right is the expertise and knowledge possessed by the supplier, unlike the the consumer The right to withdraw has implications for both supplier and consumer,The consumer is obligated to return the goods, and the supplier is obligated to refund, the price the right to withdraw expires either exercising it within the specified period, or by the expiration of the specified period.
