جريمة تلقي الهدايا في ظل القانون06-01

تهدف هذه الدراسة إلى تسليط الضوء على جريمة تلقي الهدايا باعتبارها من الجرائم الملحقة بجريمة الرشوة، وفق ما نص عليه القانون 06-01 المتعلق بمكافحة الفساد. وبيّنت أن المشرع أخذ بمبدأ ثنائية التجريم، حيث عاقب الموظف المتلقي وكذا مقدم الهدية. وتوصلت الدراسة إلى أن هذه الجريمة تقوم على صفة الموظف العمومي دون اشتراط قيامه بعمل أو امتناعه عنه. كما تميزت عن الرشوة التقليدية بعدم اشتراط المقابل المباشر، يكفي أن يكون لمقدم الهدية مصلحة قائمة أو مرتقبة لدى الموظف. Abstract This study aims to shed light on the crime of accepting gifts, considering it one of the offenses associated with bribery, as stipulated in Law 06-01 on the prevention and fight against corruption. It highlighted that the legislator adopted the principle of dual criminalization, punishing both the public official who receives the gift and the person offering it. The study found that this crime is based on the status of the public official, without requiring that they perform or refrain from performing an official act. It differs from traditional bribery in that it does not require a direct quid pro quo. It is sufficient that the gift-giver has an existing or anticipated interest with the official.
