دور الجمعيات في حماية البيئة في التشريع الجزائري

تسعى هيئات المجتمع المدني لتحقيق حماية للبيئة، وتأتي الجمعيات في الصدارة كممثل للمجتمع المدني في حمايتها للبيئة، ولهذا اهتم التشريع الجزائري كغيره من التشريعات المقارنة على الدور الفاعل الجمعوي في هذا المجال، بما في ذلك القانون رقم 10-03 المؤرخ في 17 جويلية 2003 المتعلق بحماية البيئة في إطار التنمية المستدامة، الذي نص على عدة أدوار رئيسية للجمعيات في هذا الصدد وهي: الدور الاستشاري، الدور الإعلامي، وأخيرا التقاضي ضد المخالفات البيئية. غير أن هذه المشاركة ظلت محدودة ودون التوقعات المنتظرة، بالنظر إلى جملة من المعوقات التي ساهمت في الحد من فعاليتها، مثل المعوقات القانونية والإدارية، والمعوقات المالية. الكلمات المفتاحية: البيئة، الجمعيات، الدور. Abstract: Civil society organization seeks to achieve environmental protection. Associations in the foreground as representatives of civil society in the protection of the environment, and for that Algerian legislation like other similar legislation, has worked to clarify the role of the associative actor in this field including the law 10-03 of July 17, 2003 relating to the protection of the environment un the context of sustainable development, which stipulated many role of association in this sense, namely: the role of advisory, the role of information and finally the legal role as an effective instrument in the protection of the environment. However, this participation has remained limited and below expectation, given the number of obstacles that have led to a reduction in its effectiveness, like a legal and administrative obstacles, and financial obstacles.
