إن المشرع الجزائري تناول دور المسح العقاري في تثبيت الملكية العقارية، وذلك نظرا لأهمية عملية المسح العقاري لأنها تعد الركيزة الأساسية في تأسيس السجل العقاري الذي يحدد ويعرف النطاق الطبيعي للعقارات على مستوى التراب الوطني بغرض تطهير العقارات، فالمشرع الجزائري لم يقدم تعريفا دقيقا وواضحا للمسح العقاري بل اكتفى بتحديد نطاقه الطبيعي وذلك من خلال نص المادة 02 من الأمر 75-74 المتضمن إعداد مسح الأراضي العام وتأسيس السجل العقاري، كما قام بتجنيد أشخاص وهيئات إدارية مكلفة بإنجاح هذه العملية، منها الوكالة الوطنية ولجنة مسح الأراضي بالإضافة إلى المحافظة العقارية قصد الوصول إلى نظام الشهر العقاري. الكلمات المفتاحية: المسح العقاري – الملكية العقارية – المحافظة العقارية- نظام الشهر العقاري. Abstract: The Algerian legislator dealt with the role of real estate survey in consolidating real estate ownership, due to the importance of the real estate survey process because it is considered the main pillar in the establishment of the real estate registry, which defines and defines the natural scope of real estate at the level of the national territory for the purpose of real estate purification. The Algerian legislator did not provide an accurate and clear definition of real estate survey, but rather He was satisfied with defining his natural scope, through the text of Article 02 of Ordinance 75-74, which includes the preparation of the general land survey and the establishment of the land registry, and he also recruited people and administrative bodies charged with making this process a success, including the National Agency and the Land Survey Committee in addition to the real estate governorate in order to reach the month system real estate.
