من خلال هذه المذكرة نجد ان المشرع الجزائري بموجب نص المادة 691 من القانون المدني الجزائري قد الزم المالك بعدم التعسف في استعمال حقه في الملكية العقارية لحد الحاق اضرار بالجار، والتي قد تصل لدرجة تحمله المسؤولية المدنية المقدرة من طرف قضاة الموضوع، و التي تقتصر اما على التنفيذ العيني بازالة مصدر الضرر، او التعويض في حالة استحالة التنفيذ العيني. Abstract Through this memorandum, we find that the Algerian legislator, in accordance with the text of Article 691 of the Algerian Civil Code, has obligated the owner not to abuse his right to real estate ownership to the point of causing harm to the neighbor, which may reach the point of bearing the civil liability estimated by the judges of the matter, which is limited either to In-kind implementation by removing the source of damage, or compensation in the event that in-kind implementation is impossible.
