الواقع اليوم أنَّ مدننا ومحيطها العمراني أصبحيعيش في فوضى,فجمالها يكاد يختفي تماما بسبب الظواهر السّلبيّة في البناء وعدم احترام القواعد العامّة للتّعمير بما في ذلك عقود التّعمير. هذا ما جعل المشرّع الجزائري يتدخّل للحدّ من هذه الظاهرة التّي ألقت بظلالها على المواطن والمجتمع والعمران ككل, وبالتّالي فالواجب الملقى على عاتق الدّولة التّدخل من خلالأجهزة الرّقابيّة المتمثّلة في أجهزة إداريّة وتقنيّة على المستويين المركزي والمحلّي مؤهّلة قانونا بمراقبة العمليّات المخالفة لوسائل التّهيئة والتّعمير, إلاّ أنّ تنوّعها وتشعبها أدّى إلى تضارب المصالح والمهام وعجز في تحقيق الغاية المرجوّة منها. Abstract: The reality today is that our cities and our urban environment reflects a chaos, as their aesthetic aspect maydisappear due to the negative constructions conducts and non-compliance with general housing rules, particularly housing contracts. This situation led the Algerian legislator to intervene to mitigate this situation that has cast a dark shadow on the citizen, the socity and the urban environment, as a whole. The state and authorities in charge have the responsibility to intervene by means of regulatory devices represented by administrative and technical bodies at the central and local levels legally qualified to monitor the violating operations violation the means of preparation and reconstruction,however, its diversity and complexity led to conflict of interests and tasks and an inability to achieve the desired aim.
